Terms of Service

1. Acceptance of terms
By accessing or using Letterable at letterable.io (the “Service”) you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms form a legally binding agreement between you and Letterable. We may update these Terms from time to time; continued use after a change constitutes acceptance.
2. Description of service
Letterable is a newsletter creation and publishing platform that helps individuals and teams write and send newsletters to their audiences. Features may evolve over time; we reserve the right to add, modify, or remove features without prior notice.
3. Eligibility
You must be at least 16 years of age to use the Service. By creating an account, you confirm that you meet this requirement and that the information you provide is accurate and complete.
4. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at contact@letterable.io if you suspect unauthorised access. We are not liable for any loss resulting from unauthorised use of your account.
You may not share your account with others or create accounts on behalf of another person without their explicit consent.
5. Acceptable use
You agree not to use the Service to:
- Send spam, unsolicited bulk email, or messages to recipients who have not opted in.
- Distribute malware, phishing content, or any material that is harmful or deceptive.
- Infringe any third-party intellectual property, privacy, or other rights.
- Publish or transmit unlawful, defamatory, obscene, or discriminatory content.
- Attempt to gain unauthorised access to our systems or other users’ accounts.
- Reverse-engineer, scrape, or otherwise extract data from the Service in an unauthorised manner.
- Violate any applicable local, national, or international law or regulation.
We reserve the right to suspend or terminate your account if we determine, in our sole discretion, that you have violated these rules.
6. Your content
You retain ownership of all content you create or upload through the Service (“User Content”). By submitting User Content you grant Letterable a limited, non-exclusive, royalty-free licence to host, display, and deliver that content solely to provide the Service. You represent and warrant that you have the rights necessary to grant this licence and that your content does not violate these Terms or applicable law.
We do not monitor User Content routinely, but we reserve the right to remove content that violates these Terms or applicable law.
7. Intellectual property
The Service, including its design, code, trademarks, and all content produced by Letterable, is owned by Letterable and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from our intellectual property without express written permission.
8. Third-party services
The Service may integrate with or link to third-party services (such as email delivery providers). We are not responsible for the content, privacy practices, or reliability of third-party services. Your use of those services is governed by their own terms.
9. Availability and changes
We aim to provide a reliable service but do not guarantee uninterrupted availability. We may modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We are not liable to you or any third party for such changes.
10. Disclaimer of warranties
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free, uninterrupted, or free of viruses or other harmful components.
11. Limitation of liability
To the fullest extent permitted by applicable law, Letterable shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of (or inability to use) the Service, even if advised of the possibility of such damages. Our total cumulative liability to you for any claims under these Terms shall not exceed the greater of the amounts paid by you to Letterable in the 12 months preceding the claim or €100.
12. Indemnification
You agree to indemnify and hold harmless Letterable and its affiliates, officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.
13. Termination
Either party may terminate the relationship at any time. You may close your account by contacting us. We may suspend or terminate your access for breach of these Terms, non-payment (when applicable), or at our discretion with reasonable notice. Upon termination, your right to access the Service ceases. We will handle your data as described in our Privacy Policy.
14. Governing law
These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through good-faith negotiation in the first instance. If a dispute cannot be resolved amicably, it shall be submitted to the exclusive jurisdiction of the courts of competent jurisdiction.
15. Changes to these terms
We may revise these Terms at any time. When we make material changes we will update the “Last updated” date and, where appropriate, notify registered users by email. It is your responsibility to review these Terms periodically.
